These terms and conditions apply to all purchases made on Rose Gold Studio's website. Rose Gold Studio will herein be referred to as "RGS".

approval + production

Client Service Agreement: Collectively, all the above people or businesses entering this Agreement will be referred to as the "Parties."

Purpose of the Agreement: Client wishes to hire RGS to provide services relating to Client's calligraphy and design needs as detailed in this Agreement. RGS has agreed to provide such services according to the terms of this Agreement.

Proofing Process: 

  • Please allow ample time to complete project. Taking proofing and assembly time into consideration
  • If proofs or information are not turned around within 3 business days, your workflow may be subject to interruption by other standing projects.
  • Two rounds of revisions are included with your order. Additional revisions will incur additional charges, billed separately.
  • Please note, with more rounds of revisions, the completion date will be pushed back.
  • If at any time, the project changes to an extent that substantially alters the specifications as described in the original proposal, a proposal revision memo will be sent to Client and a revised fee will be agreed upon by both RGS and Client before project moves forward.
  • It is extremely important to thoroughly check proofs for correct times, dates and spelling of all words, including names and places, in addition to design elements. It is the client’s responsibility to review that every detail is correct, including spelling, grammar and punctuation.
  • A final proof will be provided for client’s approval. Once approval is received, the Client gives RGS the permission to print all pieces as they appear on final proof.  
  • No changes can be made and RGS will not be held responsible for any errors found after your approval.
  • After Client’s final approval is received, materials are ordered and the project goes into production.
  • Once the order moves into production after final approval, errors will be corrected at Client’s expense.

Printing: Due to the nature of printing (laying ink of paper) ink colors (especially dark or saturated hues) may rub onto other cards in transit.

Color Discrepancies: Colors viewed on screen may vary slightly on the physical product. To ensure you love the print styles + colors, we recommend ordering our Sample Pack before making your final selections.

returns and refunds

Damages and issues: Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items: Due to the bespoke nature of our products and the preparation of supplies upon order placement, we cannot accept returns, offer refunds, exchanges, or cancellations on custom and personalized items. In the event of a printing error attributable to us, the item will be reprinted at no additional cost. However, if a proof containing an error is approved by you, necessitating a reprint, you will be responsible for associated expenses. Please get in touch if you have questions or concerns about your specific item.

Order Acceptance and Cancellation: We reserve the right to accept or cancel any order at our discretion. Orders may be canceled due to limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information. You will be notified if this occurs

artistic release

Client has spent a satisfactory amount of time reviewing RGS's work and has a reasonable expectation that RGS will perform the Services in a similar manner and style unless otherwise specified in this Agreement.

Terms of Use: Vendor grants to Client a non-exclusive license of product(s) produced with and for Client for personal use only so long as Client provides Vendor with attribution each time Client uses Vendor’s property. Personal use includes, but is not limited to, use within the following contexts:

  • In photos on Client’s personal social media pages or profiles.
  • In personal creations, such as a scrapbook or personal gift.
  • In personal communications, such as a family newsletter or email or holiday card.

Consistency: RGS will use reasonable efforts to ensure Client's desired Services are produced in a style and manner consistent with RGS's current portfolio and RGS will try to incorporate any reasonable suggestion made by Client. However, Client understands and agrees that:

Every client and wedding is different, with different tastes, budgets, and needs; Calligraphy and Design services are often a subjective art and RGS has a unique vision, with an ever-evolving style and technique; RGS will use its artistic judgment when providing Services for Client, which may not include strict adherence to Client’s suggestions; Although RGS will use reasonable efforts to incorporate Client’s suggestions and desires when providing Client with the Services, RGS shall have final say regarding the aesthetic judgment and artistic quality of the Services; Dissatisfaction with RGS's aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

Calligraphy: The nature of hand addressed envelopes will vary from that of printed addresses. Each address will vary depending on the letters, length or names, street names, city and state length and will visually appear different from one another when compared. Addresses with 4 to 5 lines of text will look different from those with fewer. Please have this expectation set when ordering calligraphy. Each envelope is a single work of art and must be appreciated as such.

Address List: RGS will provide a template for guest addresses. Guest Addresses will be written exactly as they appear on provided list from Client. RGS will not make etiquette or spelling corrections. If Client wishes RGS to prepare and/or make edits to guest list for calligraphy or address printing, additional charges will be billed separately.

Public Display of Designs:

  • RGS retains the right to display, photograph, distribute and/or publish any designs for the purpose of RGS’s promotional and marketing needs, via the Internet, social media pages and in RGS portfolio.
  • RGS will be sensitive to protect the client’s personal addresses when displaying these materials.
  • RGS may display images provided by the client’s event photographer on RGS online sources and will credit the photographer for any/all images used.
  • Client agrees to credit all publically displayed, blog, website (including Facebook & other social media) or newspaper submissions of any imagery including RGS original designs with credit to RGS. Please ‘Like’ our Facebook page and follow us on Instagram (@rosegoldstudio) so we can ‘tag’ you in any Facebook or blog posts relevant to custom designs.

Processing Time: Order processing time will vary depending on the availability of the products and customization requests.

Shipping Methods, Costs, and Responsibility:

  • Shipping will be carried out according to the method chosen at checkout.
  • Rose Gold Studio is not responsible for loss or delays during shipment, which are subject to the terms and conditions of the shipping provider.
  • We offer several shipping methods for orders, including standard shipping, expedited shipping, and local pick-up upon request. Please note that local-pick up will still incur a handling fee.
  • Shipping costs and delivery times vary depending on the selected shipping method and the destination.
  • Shipping costs are calculated based on the weight of the package and the shipping destination. The exact shipping cost for your order will be calculated and displayed during the checkout process.

Delivery Time: 

  • Delivery times vary depending on the selected shipping method and the destination. Expedited shipping options are available for faster delivery.
  • Please note that delivery times are estimates and may be subject to delays due to factors beyond our control, such as processing or extreme weather conditions.
  • Failure to provide necessary information, such as event date or location, will halt progress on your order until all details are furnished. While we may request missing information from you, it remains your sole responsibility to ensure completion.
  • Design work will commence only upon receipt of all required details; hence, any production timelines provided are contingent upon your provision of essential information.
  • Should you opt to include a photograph on your item, timely submission of a high-resolution image is imperative. Delays may result if this requirement is not met, affecting both proofing and production timelines.
  • We shall not be held liable for delays arising from insufficient information provided by you.

Order Tracking: Once your order has been shipped, you will receive a shipping confirmation email with tracking information. You can use this tracking information to monitor the status of your shipment and estimate the delivery date.

International Shipping: For international orders, please note that customs duties, taxes, and other fees may apply and may increase shipping time. These fees are determined by the customs authorities in the destination country and are the responsibility of the recipient. We recommend contacting your local customs office for more information about any applicable fees before placing your order.

postage + mailing

Postage & Mailing Liabilty:

  • RGS is not responsible for items lost, damaged, stolen, unreadable or undeliverable by the mail/parcel carrier.
  • RGS assumes no responsibility for damages to product caused by the mail/parcel carrier while in transit.
  • RGS cannot be held responsible for final postage rates & weights and acceptance of items by the mail/parcel carrier.
  • The USPS reads envelopes electronically. Due to the nature of calligraphy, some addresses or calligraphy styles will be more or less difficult to read when put through the USPS, as is the nature of any handwritten address.
  • Any address that can not be read by machine will most likely be hand inspected. If the address still can not be delivered, it will be returned to the address of the return.
  • RGS is not responsible for resending, reprinting, or reimbursing for invitations or addresses that are not delivered to their intended address.
  • RGS recommends waiting until you have your printed invitations in hand, and take a complete suite to your USPS to have them weigh and verify the stamps you will need to purchase – invitations often require the 2oz or 3oz weight, depending on size, weight and components.

COPYRIGHTS

Any artwork or photos sent by Client will have permission from the rightful owner to use any images and/or data provided by Client for inclusion in its material including but not limited to photos, fonts, ideas, and imagery. Client will hold harmless, protect, and defend RGS from any claim or suit arising from the use of any provided work. RGS will create original artwork or will lawfully acquire any fonts or artwork necessary to complete assigned tasks. 

All designs, images, artworks, and products showcased, advertised, or sold on this website, or incorporated into any ordered item, are the exclusive property and copyright of Rose Gold Studio, unless explicitly stated otherwise. Similarly, all designs, images, and artworks utilized or conveyed during the proofing phase remain the sole property and copyright of Rose Gold Studio. These assets may not be utilized for personal use, reproduction, creation of derivative works, or any other purpose. All content on this website is copyrighted upon creation and is subject to the United States Copyright Act of 1976 (USCA). No design, image, artwork, or product sold on this website, or provided to you during any stage of the design process, shall be considered a work made for hire under the USCA unless explicitly specified otherwise. Any intellectual property disputes shall be adjudicated in the United States District Court for the Northern District of Ohio, Eastern Division.

In the event that any copyrighted work(s) are created as a result of the Services provided by RGS in accordance with this Agreement, RGS owns all copyrights in any and all work(s) it creates or produces pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by Vendor and may be used in the reasonable course of RGS’s business. Any elements of text, graphics, photos, contents, trademarks, or other artwork furnished to client for inclusion in designs are owned by RGS. Sketches and ideas not used in final product remain intellectual property of RGS. Unless a purchase of “All Rights” is negotiated with RGS, the client may not use or reproduce the design or images therein for a purpose other than the one(s) originally stipulated. If the client wishes to use the design and/or any portion or image RGS has created, the client must contact RGS to arrange for a transfer of rights and any applicable fees before proceeding.  

PRICING

Pricing and Payment Terms: Website prices are subject to change without notice. Payment is required at the time of purchase. By making a purchase, you confirm that you have the authority to use the credit card provided for payment.

All prices listed on this website reflect the full retail price in United States dollars. We are obligated to collect sales tax, irrespective of your state of residence, as per the ruling in South Dakota v. Wayfair. 

LIMIT of LIABILITY

Force Majeure: Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

Failure to Perform Services: In the event Vendor cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and
Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
Excuse Client of any further performance and/or payment obligations in this Agreement.

Maximum Damages: Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement or Services provided in this Agreement are not to exceed the Total Cost of Services provided by Vendor.

Indemnification: Client agrees to indemnify, defend and hold harmless Vendor and its affiliates, employees, agents and independent contractors for any injury, property damage, liability, claim or other cause of action arising out of or related to Services and/or product(s) Vendor provides to Client.
